Terms of Service
1. Background
1.1.
These Terms and Conditions (“Terms”) apply when you, as a consumer (“Customer”), place an order through our website www.postereyes.art (the “Website”). The purchase agreement is concluded between you and Postereyes (“we”, “us”). Our contact details and legal information can be found in the Website’s Imprint (Impressum). These Terms apply only to consumers within the meaning of Section 13 of the German Civil Code (BGB).
1.2
The Customer must be at least 18 years old to place orders through the Website. We reserve the right to refuse an order, for example in cases of suspected fraud, incomplete information, or if payment cannot be processed.
1.3
We are not liable if products are out of stock. We are also not liable for typographical errors, image or printing errors on the Website, for example errors in product descriptions or technical specifications, incorrect prices, price changes (for example due to supplier price changes or currency changes), or incorrect information about product availability. We may correct such errors and update or change information on the Website at any time.
1.4
We aim to display our products as accurately as possible. However, colors and brightness may vary depending on your screen, device, and display settings.
1.5
The Website and all content on it are the property of Postereyes or our licensors and are protected by intellectual property laws. This means that trademarks, business names, product names, images and graphics, design, layout, and all content relating to products and services may not be used, copied, or reproduced without our prior written consent, except where such use is permitted by law.
2. Contracts and orders
2.1
To place an order through the Website, the Customer must accept these Terms. By accepting the Terms, the Customer agrees to comply with them and acknowledges our Privacy Policy, including information about the processing of personal data and the use of cookies.
2.2
A purchase agreement is concluded when the Customer receives an order confirmation from Postereyes by email. We will send the order details to you by email. We recommend that you keep the order confirmation for future reference when contacting customer support about your order.
2.3
The Customer may request cancellation before the order is shipped. If cancellation is accepted, we will refund any payments made for the cancelled order. Statutory rights, including the right of withdrawal (where applicable), remain unaffected.
3. Customer information and accounts
3.1
To place an order, the Customer must provide certain information such as name, shipping address, and contact details. The Customer confirms that the information provided is accurate and complete. Our Privacy Policy explains how we process personal data.
3.2 Accounts (if available)
If the Customer creates an account, the Customer is responsible for keeping login credentials confidential and for all activity under the account. The Customer must notify us without undue delay if they suspect unauthorized access.
3.3
We may suspend or disable an account if we reasonably suspect misuse or a violation of these Terms.
4. Prices, fees, and payment
4.1
All prices shown on the Website are in euros (EUR). Prices include VAT where applicable. Shipping costs are not included in the product price and are shown separately at checkout.
4.2
You can pay using the payment methods displayed at checkout. Available payment methods may vary depending on factors such as your location and the order value. Any discounts or promotion terms will be shown on the Website or at checkout.
4.3
Payment is due at checkout. We process and charge your payment when you place your order, unless a specific payment method provides otherwise.
4.4
We reserve the right to change or limit the available payment methods and to reject a payment method if it does not work or cannot be processed.
5. Promotions and special offers
5.1
We may occasionally offer promotions on the Website that provide more favorable terms than those stated in these Terms, for example regarding pricing or an extended withdrawal period. Such promotion terms apply only for the duration of the promotion and only to the products specified in connection with that promotion.
5.2
We reserve the right to withdraw or change promotions at any time, unless required by law. Changes do not affect orders that have already been accepted and confirmed by us.
5.3
Product promotions are valid only for a limited time and while stocks last.
5.4
Purchases made before or after a time limited promotion are not eligible for retroactive discounts or price adjustments.
6. Gift cards
6.1
Gift cards purchased from Postereyes can be used in our online store and are valid for three (3) years from the end of the year in which the gift card was purchased, unless mandatory law provides otherwise.
6.2
Gift cards are value documents and must be kept safe. Gift cards cannot be redeemed for cash. Lost or stolen gift cards will not be replaced.
6.3
Gift cards cannot be combined with discount codes, unless we explicitly state otherwise.
7. Delivery and shipping
7.1 Delivery times
In stock items are normally delivered within the delivery time shown on the Website and at checkout. Unless we agree otherwise, delivery will take place no later than 30 days after we have confirmed your order.
If you do not receive your order within the stated delivery time, please contact us at hello@postereyes.art so we can investigate with the carrier.
7.2 Delays and your right to cancel
If delivery is delayed, we will inform you where possible and continue to monitor the shipment. If delivery is significantly delayed and the delay is not caused by you, you may be entitled to cancel the purchase. In such cases, we may ask you to grant us a reasonable additional delivery period before cancellation, unless this is not required under applicable law.
7.3 Pickup shipments and uncollected parcels
If your shipment is delivered to a pickup location, you must collect it within the time stated in the carrier’s notification. You may be required to present a valid ID and your order number.
If a parcel is not collected and is returned to us, we may charge a reasonable fee to cover the additional shipping and handling costs, or deduct such costs from your refund, as permitted by law.
7.4 Risk of loss and delivery issues
We are responsible for packaging and handing over the goods to the carrier. For consumers, the risk of accidental loss or damage passes to you only when the goods are delivered to you (or a person authorized by you), unless applicable law provides otherwise.
Please inspect your delivery upon receipt. If an item is missing, damaged, or you received the wrong item, contact us as soon as possible and include photos of the packaging and the product where relevant. This does not affect your statutory rights.
8. Right of withdrawal
8.1 Withdrawal period and conditions
You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period is 30 days from the day on which you, or a person you authorize who is not the carrier, receives the goods.
Returned items must be unused and in the same condition as delivered and returned in the original packaging or equally protective packaging.
If a product is delivered with a protective seal or protective film, you must keep it intact to use your right of withdrawal. If the seal or film is removed, broken, or damaged, the right of withdrawal ends for that item. Our frames are delivered with protective film on the glass. If the protective film on the glass is removed or damaged, we cannot accept a return of the frame.
8.2 How to withdraw
To withdraw, email us at hello@postereyes.art before the withdrawal period ends. Please include your full name, address, order number or invoice number, and the product name. You may also use the model withdrawal form below, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient to send your notice before the withdrawal period expires.
8.3 Return deadline
After you notify us, you must send the goods back within 14 days.
8.4 Refunds
If you withdraw from this contract, we will refund the payments received from you for the returned products without undue delay and no later than 14 days after we receive your withdrawal notice.
Original shipping costs are not refunded. We provide a return shipping label, and the cost of return shipping will be deducted from your refund.
We refund to the same payment method you used at checkout, unless we agree otherwise. We may withhold the refund until we have received the returned item or you have provided proof that you have sent it back.
8.5 Loss in value
If an item is returned in worse condition than received, we may reduce the refund to reflect the loss in value caused by handling beyond what is necessary to inspect the item.

9. Products
9.1 Posters
We print our posters on premium paper designed for high quality art prints, with a smooth surface and a matte, non glare look. The exact paper type, finish, and weight are stated on the relevant product page.
9.2
Frames are not included unless explicitly stated.
9.3
The designs offered on our Website are created by independent designers and artists and are printed by Postereyes under the applicable licenses and print permissions. Where available, artist attribution and other relevant details are shown on the product page.
9.4
For the avoidance of doubt, the terms “poster” and “print” refer to the same product.
9.5 Frames (if offered)
We offer frames in different colors, materials, and sizes. Frame specifications such as material, profile dimensions, and glazing type (for example glass or acrylic) are stated on the relevant product page.
9.6
Where available, matching mats (passepartouts) can be purchased for certain sizes to frame the motif. Some smaller frame sizes may include a stand for shelf display. Frames are designed to be easy to open for inserting posters. Hanging orientation (portrait and or landscape) depends on the frame model and is stated on the product page.
10.Statutory warranty and complaints
10.1 Statutory warranty
Unless expressly agreed otherwise, your statutory warranty rights apply. This means that you have the legal rights provided under applicable consumer law if goods are defective.
10.2 Complaints
We may reject a complaint if the product is not defective within the meaning of applicable consumer protection law. If you believe your product is defective, please contact us at hello@postereyes.art and include your order number and photos of the product and packaging where relevant.
11. Links to third party websites
11.1
The Website may contain links to third party websites that we do not control, and third parties may provide links to our Website. We are not responsible for the privacy practices, security, or content of third party websites.
11.2
If you follow a link to a third party site, you do so at your own risk. Please review the privacy and security policies that apply to that third party website before providing any personal data.
12.Liability
12.1 Unlimited liability
We are liable for intent and gross negligence. We are also liable in accordance with mandatory product liability laws and for damages resulting from injury to life, body, or health.
12.2 Liability for slight negligence
In cases of slight negligence, we are liable only for the breach of an essential contractual obligation (a “cardinal duty”), meaning an obligation whose performance is necessary to properly perform the contract and on which the Customer may typically rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract. This limitation also applies to our agents and subcontractors.
12.3 Events outside our control (force majeure)
We are not liable for delays or failures caused by circumstances beyond our reasonable control, for example industrial disputes, war, fire, lightning, terrorist attacks, government measures, technical failures, disruptions in power or telecommunications, or delays by subcontractors caused by such circumstances.
12.4
If such circumstances occur, we will inform the Customer. If the situation continues for more than two (2) months, both the Customer and Postereyes may withdraw from the contract with immediate effect, subject to mandatory consumer rights.
13. Changes to these Terms
13.1
We may update these Terms from time to time. The version published on the Website at the time you place your order applies to that order.
13.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain valid and enforceable.
13.3 Governing law
These Terms and contracts between you and us are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
